Assumption of Risk and Release of Liability

I knowingly and voluntarily assume all risks of illness, injury, death, or property damage arising from my participation in the Event. In consideration of being permitted to participate in the Event, I, on behalf of myself, my heirs, executors, administrators, agents, and assigns, hereby irrevocably and forever release, waive, discharge, and hold harmless the Event, its organizers, affiliates, sponsors, officers, directors, employees, agents, volunteers, contractors, and assigns (collectively, "Hosts") from any and all claims, liabilities, causes of action, losses, damages, costs, and expenses (including attorneys' fees) arising out of or in any way connected with my participation in the Event, whether arising from the negligence of the Hosts or otherwise, to the fullest extent permitted by law.

Photography, Recording and Publicity Release

I acknowledge that the Event may include activities that are not to be photographed, streamed, or recorded. I consent (where applicable) to the Hosts photographing, filming, and recording me, my work, or my child in connection with the Event and grant the Hosts, their licensees, successors, and assigns the perpetual, worldwide, royalty-free right to use, reproduce, distribute, modify, publicly display, broadcast, and create derivative works of such photographs, videos, audio recordings, and my name, likeness, or work for any purpose, including promotional purposes, without further compensation or approval.

Indemnification

I agree to indemnify, defend, and hold harmless the Hosts from and against any and all third‑party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or resulting from my acts or omissions, my products or materials, or any breach of my representations or obligations under this Agreement, including claims of intellectual property infringement.

Content and Merchandise Representations; Prohibitions

I represent and warrant that any materials, products, games, displays, or other items I display, sell, or distribute at the Event: (a) do not infringe any third-party intellectual property rights; (b) are not obscene, pornographic, defamatory, or otherwise unlawful; and (c) comply with all applicable laws, rules, and regulations. The sale, display, or distribution of counterfeit goods, infringing merchandise, food, beverages (including alcohol), tobacco, or drug paraphernalia is strictly prohibited. The Hosts reserve the right to refuse, remove, or prohibit any item at any time.

Taxes and Reporting

I am solely responsible for reporting and paying any and all taxes, including income, sales, payroll, FICA, FUTA, and state and federal withholding taxes arising from any compensation, sales, or monies I collect in connection with the Event. The Hosts will not file tax forms on my behalf.

Account Security; Website and System Use

I will not share my account credentials. Only one login per ticket is permitted at a time. The Event system may automatically log me out after periods of inactivity. I acknowledge that cookies and other browser settings may be required for full functionality. I consent to communications to the email address I provided.

Raffles, Animals, and Other Activities

No raffles, lotteries, auctions, amusement rides, or animals will be permitted on the premises without prior written permission from the Hosts.

Setup, Transportation, Union Rules, and Removal of Property

If authorized to display items, I will obtain written authorization and will transport, set up, and remove all authorized items (including but not limited to games, machines, or displays) during designated load-in and load-out times. If the venue requires union labor, loading docks, marshalling yards, or other procedures, I will coordinate and comply at my expense. Items not removed within one hour after the Event ends may incur a storage/processing fee of $150 per day, beginning the day the Event ends. Items not moved in during load-in time may be refused entry to the Event or treated as forfeited. I will ensure my equipment remains operational during the Event and will not leave it unattended.

Safety, Venue Conditions, and Property Loss

I understand the venue may present hazards (including crowds, cables, electrical wiring, narrow aisles, and other risks). I will secure all cords, wires, and equipment to prevent hazards. The Hosts are not responsible for loss, theft, or damage to personal property. The Hosts are not liable for personal injury except to the extent caused by the Hosts' gross negligence or willful misconduct, to the extent permitted by law.

Emergency Medical Treatment

In the event of an emergency, I authorize the Hosts and their representatives to seek or provide emergency medical treatment for me and I agree to be financially responsible for any such treatment and related transportation.

Conduct; Suspension and Removal

I will comply with all applicable laws and Event rules and will conduct myself in a professional and appropriate manner. Harassment, offensive behavior, profanity, or other objectionable conduct is prohibited. Display spaces may not be sublet, assigned, or transferred without prior written consent. The Hosts may refuse admission, suspend, or terminate participation in their sole discretion for noncompliance. Removal or suspension does not entitle Participant to any refund unless the Hosts decide otherwise in writing.

Cancellation; Modifications; Fees

The Hosts may cancel, terminate, modify, reschedule, or suspend the Event for any reason, including technical failures or causes beyond their control. Event fees are non-refundable and non-transferable unless otherwise agreed in writing. Requests for changes are handled on a first-come, first-served basis as space allows.

Accessibility and Accommodations

Reasonable accommodations are available for participants with disabilities. To request accommodations, please fill out the Contact Us form at least 14 days before the Event.

Health and Communicable Diseases

I represent that I have not experienced symptoms related to COVID-19 or other communicable diseases (e.g., fever, difficulty breathing, persistent cough) within the prior 14 days, and I will not attend the Event if I experience any such symptoms within the 14-day period before the Event begins. I acknowledge the risk of exposure to communicable diseases at the Event and agree to follow Hosts' health and safety requirements (which may include mask-wearing) regardless of vaccination status. The Hosts cannot guarantee I will not be exposed to or contract communicable diseases at the Event.

Insurance

The Hosts do not provide health, medical, disability, or liability insurance for participants. Participants are encouraged to maintain their own health and liability insurance. If authorized to display items, I shall, at my own expense, maintain commercial general liability insurance with limits of not less than $1,000,000 per occurrence and $2,000,000 aggregate, and property insurance covering my equipment. Upon the Organizer's request, I will provide a certificate of insurance evidencing these limits and naming the Organizer and Venue as additional insureds at least 14 days prior to the Event; the additional-insured endorsement shall be primary and non‑contributory where permitted by law.

Website; Portal; 2D/3D Virtual Worlds; No Warranty

The Hosts may update their website, portal, 2D and 3D virtual environments and reserve the right to approve, modify, cancel, or remove content, games, booths, panels, schedules, and other features. All content is provided "as is" without warranties of any kind. The Hosts disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and accuracy of content to the fullest extent permitted by law. The Hosts are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of data or profits, arising from or in connection with the Event or use of the Hosts' online platforms.

No Endorsement; Logo Display

Event and Hosts may display my name, logo, trademark, and related marks ("My Marks") in any media for Event‑related purposes (e.g., marketing, website, social media, presentations, proposals, and promotional materials). Use of My Marks is for identification only and does not imply endorsement or sponsorship by me or by the Event and Hosts. I retain all right, title, and interest in My Marks; the Event and Hosts acquire no ownership. I grant the Event and Hosts a perpetual, worldwide, royalty‑free, non‑exclusive, transferable license to reproduce and use My Marks.

Data, Privacy, and Communications

By registering or attending, I consent to the Hosts contacting me regarding the Event using the contact information I provided.

Governing Law; Severability; Modification

This Agreement is governed by the laws of the State of Colorado without regard to conflicts of law principles. If any provision is found invalid or unenforceable, it will be modified to the extent necessary to be enforceable, and the remaining provisions will remain in full force. This Agreement constitutes the entire agreement between the parties and supersedes all prior oral or written agreements. Any amendment must be in writing and signed by an authorized representative of the Hosts.

Age; Prizes

I certify that I am at least 18 years old. I must be present to claim or win any prizes. If signing for a minor, I certify I am the parent or legal guardian and agree to these terms on the minor's behalf.

Signature and Electronic Acceptance

I acknowledge that I have read this Agreement, understand its terms, and agree to it voluntarily, intending to be legally bound. My electronic acceptance (e.g., checking an "I agree" box) or digital or physical signature is effective as an original signature. The Hosts will retain records of acceptance, including the date, time, and the version of the Agreement accepted.
